Terms & Conditions

The terms that govern your use of volpeservice.com and the services we provide. Please read carefully — they include an arbitration agreement and limitations on liability.

Please read carefully. Section 15 (Binding Arbitration & Class-Action Waiver) requires that disputes be resolved by individual arbitration in New Jersey and waives the right to a jury trial and class actions. You may opt out of arbitration within 30 days of first using our services or site — see Section 15 for how to opt out.

These Terms & Conditions ("Terms") are a binding agreement between you and Volpe Service Company LLC, doing business as Volpe Service Company ("Volpe Service Company," "we," "us," or "our"). They govern your use of volpeservice.com ("Site") and the HVAC services we provide ("Services"). By using the Site or requesting Services, you agree to these Terms.

1. Eligibility

You must be at least 18 years old and legally authorized to enter into binding contracts (or, if you are entering into these Terms on behalf of a business, you must have authority to bind that business). The Site is intended for residents of the United States. If you access it from outside the United States, you do so on your own initiative and are responsible for local-law compliance.

2. Our Services

Volpe Service Company provides HVAC services (heating, air conditioning, heat pumps, ductless, boilers, indoor air quality, and related work) in New Jersey, primarily in Morris and Essex County. We hold New Jersey Master HVAC License 19HC004579. Specific services, availability, response times, and pricing are subject to change.

3. Estimates, Quotes, and Pricing

Any quote, estimate, or price information on the Site or provided verbally is for general informational purposes and is not a binding offer. A binding price is set only by a written, signed service agreement or invoice between you and Volpe Service Company. Actual cost may vary based on site conditions, equipment availability, code requirements, and scope of work discovered during service. We will tell you of material changes before performing additional work.

4. AI and Automated Content

The Site and our tools may use artificial intelligence in limited ways — for example, an AI chat assistant, content suggestions, online estimators, or automated scheduling. Outputs from these tools are illustrative only, are not professional HVAC advice, and may be inaccurate or incomplete. All diagnostic work, recommendations, and quotes that affect a real job are performed and reviewed by licensed Volpe technicians — never by AI alone. You should not rely on any AI-generated estimate as a binding price or as a substitute for an in-person diagnostic by a qualified technician.

5. No Professional Advice

Information on the Site (including blog posts, Learning Center articles, FAQ content, and any educational material) is general information about HVAC topics and is not professional advice. It is not a substitute for an in-person inspection by a licensed HVAC contractor for your specific home or building. Local building codes vary; always confirm current requirements with your municipal construction office before making decisions that depend on code compliance.

6. Intellectual Property

The Site and all content on it (other than user content) — including text, graphics, photographs, illustrations, the Volpe wordmark and logo, and the site's design, layout, and code — are owned by or licensed to Volpe Service Company LLC and are protected by copyright, trademark, and other laws. You receive a limited, revocable, non-exclusive, non-transferable license to access and use the Site for your personal, non-commercial purpose of learning about and requesting our Services. You may not copy, modify, distribute, sell, scrape, or use any Site content for commercial purposes without our written permission.

7. Acceptable Use

You agree not to:

  • Use the Site for any unlawful, harmful, or fraudulent purpose;
  • Attempt to gain unauthorized access to any part of the Site, our systems, or our customers' accounts;
  • Use bots, scrapers, or other automated tools to access the Site, except for legitimate search-engine indexing;
  • Interfere with or disrupt the Site's operation, including by submitting viruses, denial-of-service traffic, or malicious code;
  • Submit false, misleading, or fraudulent information (e.g., booking a fake service appointment, applying for financing with another person's identity);
  • Reverse engineer, decompile, or disassemble any portion of the Site.

8. User Submissions

If you submit a review, photo, testimonial, or other content to us ("Submission"), you grant Volpe Service Company a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to use, display, modify, and distribute the Submission on the Site, in marketing, and in connection with our business — with attribution where reasonable. You represent that you own or control the rights to the Submission and that it does not violate any third party's rights.

9. Third-Party Services and Links

The Site links to third-party services (financing applications, manufacturer warranty registration, review platforms, payment processors). We do not control those third-party services and are not responsible for their content, accuracy, or practices. Your use of those services is governed by their own terms and privacy policies.

10. Pricing, Payment, and Financing

For work performed at your property, payment terms are set in your service agreement or invoice. If you finance work through one of our partners (Synchrony, Wisetack, NEIF, or GreenSky), your financing relationship is governed by your separate agreement with that lender. We are not a lender and do not control credit decisions. PSE&G SaveGreen and Elizabethtown Gas rebates are administered by the utility programs; we help with paperwork but cannot guarantee approval, amount, or timing.

11. Warranties — AS-IS / AS-AVAILABLE

THE SITE AND ITS CONTENT ARE PROVIDED "AS-IS" AND "AS-AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, and uninterrupted availability. We do not warrant that the Site will be error-free or that defects will be corrected.

Workmanship and equipment warranties: our installation work and equipment carry the warranties stated in your written service agreement or invoice. Manufacturer warranties on installed equipment (Amana, Carrier, Trane, Lennox, Bryant, Mitsubishi, Daikin, etc.) are governed by the manufacturer's terms. The disclaimers in this Section 11 apply to the Site only — they do not affect your workmanship warranty.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER VOLPE SERVICE COMPANY LLC, VOLPE SERVICE COMPANY, NOR ANY OF OUR OWNERS, EMPLOYEES, OR CONTRACTORS WILL BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST DATA, BUSINESS INTERRUPTION, OR PERSONAL INJURY EXCEPT WHERE CAUSED BY OUR OWN NEGLIGENCE OR WILLFUL MISCONDUCT — ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR THESE TERMS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY.

OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE — EXCLUDING THE PERFORMANCE OF SERVICES UNDER A WRITTEN SERVICE AGREEMENT, WHICH IS GOVERNED BY THAT AGREEMENT — WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100.00) OR, IF GREATER, THE TOTAL AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow the exclusion of certain warranties or limitations on certain damages, so some of the above limitations may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.

13. Indemnification

You agree to defend, indemnify, and hold harmless Volpe Service Company LLC, its owners, employees, contractors, and agents from any claim, demand, liability, loss, damage, cost, or expense (including reasonable attorneys' fees) arising out of (a) your use of the Site, (b) your violation of these Terms, (c) your violation of any law or third-party right, or (d) any Submission you provide.

14. Governing Law and Venue

These Terms and any dispute arising out of them are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws principles. Subject to Section 15, the exclusive venue for any judicial action arising out of or relating to these Terms is the state or federal courts located in Morris County, New Jersey, and you consent to the jurisdiction of those courts.

15. Binding Arbitration & Class-Action Waiver

Please read carefully. This Section affects your legal rights.

Except for (i) small-claims court actions, (ii) claims for injunctive relief to stop unauthorized use of our intellectual property, and (iii) any dispute that cannot be arbitrated under applicable law, any dispute arising out of or relating to these Terms or your use of the Site or Services will be resolved by binding individual arbitration, not in court. You and Volpe Service Company both waive the right to a jury trial and to participate in a class action, class arbitration, or representative action.

The arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules, conducted by a single arbitrator in Morris County, New Jersey (or by phone or video at the arbitrator's discretion). The arbitrator's decision will be final and binding and may be entered as a judgment in any court of competent jurisdiction. Each party bears its own attorneys' fees and costs, except as the arbitrator may allocate under applicable law.

How to opt out of arbitration: you may opt out of this arbitration agreement within 30 days of first using the Site or our Services by sending a written notice to: Volpe Service Company LLC, Attn: Arbitration Opt-Out, 299 Ridgedale Ave, PO Box 242, East Hanover, NJ 07936, or by emailing [email protected] with the subject "Arbitration Opt-Out." Include your full name, address, and a clear statement that you opt out of arbitration. Opting out does not affect any other provision of these Terms.

If any portion of this Section 15 is found unenforceable, it will be severed and the remainder will remain in force. If the class-action waiver is unenforceable as to a particular claim, that claim (and only that claim) will be heard in court under Section 14.

16. Notice of Dispute

Before initiating arbitration or any court action, you agree to send us written notice of the dispute, describing the claim and the relief sought, by mail to the address in Section 19 or by email to [email protected]. We will attempt to resolve the dispute informally for 30 days. If unresolved, you or we may proceed under Section 14 or 15.

17. Termination

We may suspend or terminate your access to the Site at any time without notice if you breach these Terms or use the Site in a way that we reasonably consider harmful. Sections 6, 8, 11, 12, 13, 14, 15, 16, 18, and 19 survive termination.

18. Miscellaneous

  • Entire agreement. These Terms and our Privacy Policy are the entire agreement between you and Volpe Service Company concerning the Site and supersede prior agreements on the same subject.
  • No waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.
  • Severability. If any provision is held unenforceable, the rest remain in force.
  • Assignment. You may not assign these Terms. We may assign them to a successor or affiliate without notice.
  • Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control (severe weather, power outages, supply-chain interruptions, labor actions, public-health events, etc.).
  • Changes. We may update these Terms from time to time; the updated version takes effect on the "Effective date" above. Material changes will be highlighted. Continued use after the effective date constitutes acceptance.

US State Privacy Rights. If you are a California resident, you have rights under the CCPA/CPRA regarding your personal information, including the right to opt out of the sale or sharing of personal information, and residents of other US states may have similar rights under their state privacy laws. Please see the "Your Privacy Choices" section of our Privacy Policy — also reachable via the "Do Not Sell or Share My Personal Information" link in the footer — for the categories of information we collect, your rights, and how to exercise them.
